yes - the shock works now after the second servicing.  they sent back a list of parts replaced and i had a couple of conversations with the c.s. and tech guy.  

they were trying to tell me the issue was my fault as i was putting the shock on an untested bike.  
i asked why they sell single shocks for bikes other than the new treks (that the shocks go on).  

they said the shock was on a bike that had a different leverage ratio -
i told them the k2 was 2.7 and the treks were 2.6.  

they said the shock was not mounted properly and the noise was coming from the mounts -
i politely told them the cross bolts were torqued to 150 inch pounds and the "FOX RC!!!" that just came off the bike didn't make the sounds.

they said my swingarm plate was interfering with the shraeder valve and that was causing the noise as well - they sent me a closeup pic of valve with scratches on it from the plate.  
i told them that was from the mounting process as i had to compress the shock to run the arm thru it's travel to see if the mount was hitting - it did a few times and i carved additional material to account for the travel and doesn't come close to it now.

it works well, better than a noleen, much lighter than but not as plush as the 5th or an RC.  the adjustments work and it is fun to move the back end of the bike up and down about and inch and a half pending conditions.

worth the money? not really - get a good fork instead.

The informed consumer wins another round-or two!    So much for the much lauded Fox c.s.  Thanks for the input as I had my eyes on one of these shocks a short while ago.

i do have to admit that they are anxious to please and make everything right, maintaining positive comments about the company, however -

when something does go wrong, it is not necessarily the fault of the consumer.  
(many companies, not implying fox, function that way even in office politics - i.e finger pointing)
