Title: Fractured (?)855 strut !!!

Help....... I have just brought this new strut off Ebay for my 855 last week.I eagerly unwrapped it only to find what looked like a hairline fracture on one of the legs. I noticed when i applied the smallest amount of pressure on the end of the strut legs i can detect the slightest sideways movement. !!! The other side does not look like the picture !I am sure it shouldn't do this ! Does this mean that the "bond" is faulty and is it safe to ride? The seller has offered a refund but i guess i am reluctant to return it because they are so rare to come by. Just how are these struts manufactured and is there any chance of a repair if it is faulty ? Bummer..........I've waited a year for one of these!!!!  :'( :'( :'(
